The Primacy of EU Law: new controversies about its scope and limits

On May 18, 2026 the Department of European Law hosted the very interesting lecture by internationally renowned Professor of European Law Bruno De Witte, followed by a lively discussion with Professor Erika de Wet (Department of International Law and International Relations), Prof. Paul Gragl (Department of European Law) and Prof. Marcus Klamert (Department of European Law).

 

The lecture revisited the primacy of EU law. First proclaimed by the Court of Justice more than 60 years ago, in the Costa v ENEL judgment, primacy has a simple core meaning, namely that national courts must make EU law prevail over national law in the case of conflict. The practical consequences of that simple rule have developed over the years, and the presentation will critically discuss some recent developments regarding the scope of primacy, as understood by the Court of Justice, and will also discuss the recent cases of resistance against the full acceptance of primacy by the national (constitutional) courts of some EU states. This resistance culminated in the infringement action Commission v Poland, leading to the Court of Justice’s judgment of 18 December 2025.

Von 29. bis 31. Oktober 2025 werden die Mitarbeiter:innen des Institutes für Europarecht zu einem Retreat im Bundesinstitut für Erwachsenenbildung in Strobl/Wolfgangsee zusammenkommen. An diesen drei Tagen wird jede/r Forscher:in ihren/seinen Forschungsschwerpunkt präsentieren und zu anschließender wissenschaftlicher Diskussion, Auseinandersetzung und Feedback stellen. Weiters werden wir als Team an der Vision und Mission des Europarechtsinstitutes arbeiten, um das beste Potential des Institutes für Europarecht in der Zukunft umsetzen zu können.
